On October 18, 2023, Rathje Woodward filed an amicus brief in the Seventh Circuit on behalf of law school professors Caprice Roberts and Doug Rendleman in Bad River Band of the Lake Superior Tribe of the Chippewa Indians v. Enbridge Energy. In that case, the trial court found in favor of the Band on its trespass claim against Enbridge and awarded $5 million in restitution. In its amicus brief, filed in support of the plaintiffs, Rathje argued that the trial court’s restitution award was unreasonably law and contrary to federal common law governing restitution awards. Rathje attorneys Tim Elliott and Paris Smith participated in drafting that brief.
